Legal Basis
National legal norms and international treaties establish that privacy is an inalienable and inherent right of all human beings. It is of vital importance to manage in our initiatives the fulfillment of the rights that these involve.
The information will be handled for the purpose for which it was requested. Mediformula respects the right to privacy, and will provide third parties with the personal information of professionals only to fulfill the purpose for which the program was created.
The applicable law establishes the rights of the holders of personal data with respect to the processing of such data, as well as the obligations of the administrators of such data.
The following policies for data management are established below:
Definitions
1-) Database: any file, archive, register or other structured set of personal data, which are subject to treatment or processing, automated or manual, whatever the modality of its elaboration, organization or access.
2-) Personal data: any data relating to an identified or identifiable natural person.
3-) Personal data of unrestricted access: data contained in public databases of general access, as provided for by special laws and in accordance with the purpose for which such data were collected.
4-) Restricted access personal data: that which, even being part of public access records, is not of unrestricted access because it is of interest only to its owner or to the Public Administration.
5-) Sensitive data: information relating to a person’s private sphere, such as those revealing racial origin, political opinions, religious or spiritual convictions, socioeconomic status, biomedical or genetic information, sexual life and orientation, among others.
6-) Duty of confidentiality: obligation of those responsible for databases and the personnel in charge of them to keep confidentiality when exercising the powers granted by law, mainly when accessing information on personal and sensitive data. This obligation shall continue even after the relationship with the database has ended.
7-) Data Subject: natural person, owner of the data subject to automated or manual processing.
8- ) Database controller: natural or legal person who administers, manages or is in charge of the database, whether it is a public or private entity, competent, according to the law, to decide what is the purpose of the database, which categories of personal data shall be recorded and what type of processing shall be applied to them.
9-) Processing of personal data: any operation or set of operations, carried out by means of automated or manual procedures and applied to personal data, such as collection, recording, organization, preservation, modification, extraction, consultation, use, communication by transmission, dissemination or any other form that facilitates access to them, matching or interconnection, as well as their blocking, deletion or destruction, among others.
The data safeguarded by Mediformula, as detailed in the previous point, will be used for the aforementioned purposes, for the respective database, and will be administered solely for the purpose indicated to the users of the initiative.
Those who may exercise their rights of access, rectification, cancellation and opposition in relation to the processing of their personal data by contacting Mediformula through the information indicated in the notifications section of this Privacy and Personal Data Management Policy.
Communications or exchange of information
Additional information that Mediformula may exchange with users or companies participating in this initiative may consist, without limitation, of the following communications: welcome messages, notifications related to acquired information – such as policy changes – and information about new services.
All those involved in the exchange of information will be consulted and may revoke their consent at any time by contacting Mediformula through the means of contact indicated in the notifications section of this Privacy and Personal Data Management Policy.
Authorized Personnel
In accordance with current legislation, only personnel authorized by Mediformula, internal or external collaborators as required, may access the data described above.
Technical and Administrative Measures
Mediformula, through this initiative, has defined the measures that support the security of the information contained in the databases, the confidentiality and integrity of the information and to ensure that it is not accessed by unauthorized third parties, ensuring that it is only used to fulfill the purpose for which it was created. However, it cannot guarantee that such actions will prevent all types of unauthorized access to the information. In case there is a particular risk of data security breach, Mediformula will immediately issue a notice informing the owners of the personal data about such risk in a timely manner.
IP Addresses and Automatic Information
